Tanah Sarawak: Mixed Zone vs Native Area

Tanah Sarawak tidak boleh dilihat sama seperti rumah subsale biasa. Risiko utama bukan hanya harga, tetapi classification, siapa boleh membeli, baki lease, kategori guna tanah, caveat, charge, akses dan status NCR. Pasukan kami menulis panduan ini sebagai senarai semak awal untuk pembeli, bukan sebagai legal opinion.
Kelas tanah dalam Sarawak Land Code
Sarawak Land Code menyenaraikan beberapa kelas tanah utama termasuk Mixed Zone Land, Native Area Land, Native Customary Land, Interior Area Land dan Reserved Land. Istilah ini penting kerana ia mempengaruhi siapa yang boleh berurusan, bagaimana tanah boleh dipindah milik, dan semakan apa yang wajib dibuat sebelum jual beli.
Mixed Zone Land secara umum ialah kelas yang lebih terbuka untuk urusan pasaran, termasuk pembeli bukan native, tetapi ia bukan lesen untuk membeli tanpa semakan. Title masih perlu disemak untuk lease expiry, syarat nyata, sekatan kepentingan, charge, caveat dan kategori penggunaan. Untuk kawasan bandar seperti Kuching, Sibu, Bintulu dan Miri, Mixed Zone sering menjadi istilah yang pembeli dengar, tetapi keputusan tetap bergantung pada title sebenar.
Native Area Land berbeza. Jangan anggap semua pembeli boleh membeli hanya kerana tanah ada dokumen atau penjual bersedia menjual. Status native/non-native, sekatan title dan consent perlu disemak. Jika pembeli bukan native atau status pembeli tidak jelas, peguam Sarawak wajib dilibatkan sebelum bayaran dibuat.
Mixed Zone vs Native Area: siapa boleh beli
Soalan “siapa boleh beli” tidak boleh dijawab berdasarkan lokasi sahaja. Mixed Zone mungkin lebih mudah untuk urusan biasa, tetapi title boleh ada syarat tersendiri. Native Area memerlukan semakan lebih berhati-hati kerana hak dan kelayakan pembeli berkait undang-undang Sarawak, terutamanya seksyen 8 Kanun Tanah Sarawak (Land Code, Cap. 81), yang menjadikan tidak sah bagi bukan anak negeri memperoleh hak atau keistimewaan atas tanah kelas tertentu, tertakluk kepada peruntukan Kanun. Jika seseorang berkata “boleh tukar nama kemudian”, itu bukan jawapan yang cukup.
Untuk pembeli, langkah selamat ialah minta salinan title terkini dan jalankan official search. Untuk penjual, jangan pasarkan tanah sebagai “boleh dibeli semua orang” jika classification belum disahkan. Untuk bacaan umum lain, rujuk FAQ dan halaman kawasan seperti Bintulu jika anda menilai lokasi di luar Kuching.
NCR: kesedaran sahaja, bukan panduan beli
Native Customary Rights atau NCR ialah topik sensitif dari segi undang-undang. Jabatan Tanah dan Survei menerangkan bahawa native customary land menurut Sarawak Land Code melibatkan hak adat yang diwujudkan secara sah sebelum 1 Januari 1958 dan masih wujud, tanah dalam reserve tertentu, atau Interior Area Land dengan hak diwujudkan menurut permit tertentu. Jabatan juga menyatakan kewujudan NCR ditentukan melalui rekod rasmi, aerial photo interpretation, dokumen relevan dan pemeriksaan di lapangan.
Maksud praktikalnya: jangan layan NCR seperti lot biasa. Jangan bayar deposit berdasarkan cerita kampung, screenshot peta, surat tidak lengkap atau janji bahawa title akan keluar kemudian. Jika transaksi melibatkan NCR, dapatkan nasihat peguam Sarawak dan semakan rasmi. Artikel ini tidak mengajar cara membeli NCR.
Semakan rasmi di Lands & Surveys
Sebelum booking, buat official title search atau minta peguam menjalankannya. Jabatan Tanah dan Survei menyenaraikan carian title document dan instrument sebagai perkhidmatan rasmi berbayar. Semak nama pemilik berdaftar, nombor lot, keluasan, lease commencement dan expiry, annual rent, syarat nyata, land use category, caveat, charge dan sekatan.
Semak juga land rent. Jabatan menerangkan bahawa land rent perlu dibayar dan kegagalan membayar boleh membawa tindakan statutory. Tunggakan mungkin nampak kecil, tetapi ia tanda bahawa pengurusan tanah tidak kemas. Untuk tanah leasehold, baki lease penting kerana ia boleh menjejaskan nilai, pembiayaan dan kebolehpasaran.
Lease, land use, caveat dan akses
Kategori guna tanah mesti selari dengan rancangan pembeli. Jangan beli tanah agriculture dengan andaian boleh terus bina rumah, pecah lot atau buat kedai. Jabatan Tanah dan Survei melalui Planning Branch menyebut kerja seperti land conversion, amalgamation, subdivision, variation of title conditions dan reclassification sebagai urusan yang diproses. Ini menunjukkan perubahan syarat bukan automatik.
Caveat, charge dan encumbrance perlu disemak oleh peguam kerana ia boleh menjejaskan pindah milik. Akses pula perlu disemak secara rasmi, bukan sekadar jalan tanah yang orang biasa guna. Akses yang tidak jelas boleh menimbulkan risiko pembangunan, pembiayaan dan jualan semula. Jika ada pertindihan sempadan, minta semakan pelan dan boundary di lapangan.
Bila peguam wajib dilibatkan
Libatkan peguam apabila tanah Native Area, NCR, ada caveat, ada charge, lease pendek, pemilik ramai, pusaka, consent diperlukan, akses tidak jelas, atau pembeli bukan native mahu membeli tanah yang classification-nya meragukan. Untuk transaksi tanah, peguam bukan kos tambahan semata-mata; peguam ialah kawalan risiko.
Untuk pembeli yang baru mula melihat tanah, elakkan tekanan untuk membuat keputusan pada hari yang sama. Tanah yang betul masih perlu lulus semakan title, akses, syarat guna tanah dan kemampuan kewangan. Jika penjual tidak mahu memberi masa untuk carian rasmi, itu sendiri tanda supaya pembeli berhenti dahulu.

Sarawak land: Mixed Zone vs Native Area

Sarawak land should not be treated like an ordinary subsale house. The main risks are not only price, but classification, who may buy, remaining lease, land use category, caveat, charge, access and NCR status. Our team prepared this as an early buyer checklist, not a legal opinion.
Land classes under the Sarawak Land Code
The Sarawak Land Code refers to key land classes including Mixed Zone Land, Native Area Land, Native Customary Land, Interior Area Land and Reserved Land. These terms matter because they affect who may deal with the land, how it may be transferred, and what must be checked before sale and purchase.
Mixed Zone Land is generally the class people associate with wider market dealings, including non-native purchasers, but it is not permission to buy without checking. The title still needs to be reviewed for lease expiry, express conditions, restrictions in interest, charges, caveats and land use category. In towns such as Kuching, Sibu, Bintulu and Miri, buyers may hear the term Mixed Zone often, but the actual title remains the deciding document.
Native Area Land is different. Do not assume every buyer can purchase simply because there is a document or because the seller is willing. Native/non-native status, title restrictions and consent must be checked. If the buyer is non-native or the buyer’s status is unclear, a Sarawak lawyer should be involved before any payment is made.
Mixed Zone vs Native Area: who can buy
“Who can buy” cannot be answered by location alone. Mixed Zone may be easier for ordinary dealings, but a title can still contain its own conditions. Native Area requires more careful review because buyer eligibility and rights are tied to Sarawak law, in particular section 8 of the Sarawak Land Code (Cap. 81), which makes it unlawful for a non-native to acquire rights or privileges over land of certain classes, subject to the Code. If someone says “the name can be changed later”, that is not enough.
For buyers, the safer step is to request a current title copy and run an official search. For sellers, do not market land as “open to everyone” if the classification has not been confirmed. For general reading, see FAQ and an area page such as Bintulu if you are reviewing land outside Kuching.
NCR: awareness only, not a buying guide
Native Customary Rights, or NCR, is legally sensitive. The Land and Survey Department explains that native customary land under the Sarawak Land Code involves rights lawfully created before 1 January 1958 and still subsisting, land in certain reserves, or Interior Area Land where rights were created under a permit. The Department also states that NCR is determined using official records, aerial photo interpretation, relevant documents and ground checks.
The practical point is simple: do not treat NCR as an ordinary lot. Do not pay a deposit based on village stories, map screenshots, incomplete letters or promises that title will come out later. If NCR is involved, get Sarawak legal advice and official checks. This article is not a guide on how to buy NCR land.
Official checks at Lands & Surveys
Before booking, run an official title search or ask your lawyer to do it. The Land and Survey Department lists searches of title documents and instruments as official paid services. Check the registered proprietor, lot number, area, lease commencement and expiry, annual rent, express conditions, land use category, caveat, charge and restrictions.
Check land rent as well. The Department states that land rent must be paid and non-payment can lead to statutory action. Arrears may look small, but they can signal poor land administration. For leasehold land, remaining lease matters because it may affect value, financing and resale.
Lease, land use, caveats and access
Land use must match the buyer’s plan. Do not buy agricultural land assuming you can immediately build a house, subdivide or run a shop. The Land and Survey Department’s Planning Branch refers to processes such as land conversion, amalgamation, subdivision, variation of title conditions and reclassification. This shows that changes are not automatic.
Caveats, charges and encumbrances should be checked by a lawyer because they may affect transfer. Access should also be checked officially, not merely treated as a track that people use. Unclear access may create development, financing and resale risks. If boundaries are unclear, ask for plan and on-site boundary checks.
When a lawyer is a must
Involve a lawyer when the land is Native Area, NCR is mentioned, there is a caveat or charge, the lease is short, there are multiple owners, estate issues, consent requirements, unclear access, or a non-native buyer wants to buy land with uncertain classification. For land transactions, a lawyer is not just an extra cost; the lawyer is part of the risk control.
For buyers who are new to land, avoid pressure to decide on the same day. A suitable parcel still has to pass checks on title, access, land use conditions and financing capacity. If the seller will not allow time for an official search, that itself is a reason to pause.
